Terms of Use

1. Acceptance and capacity

By using the Services you confirm you are at least 18 years old and have the legal capacity to enter this agreement. Your use constitutes unconditional acceptance. We may update these Terms at any time in our sole discretion; continued use after changes signifies agreement to the revised Terms.

2. Scope of services — we may change or stop anything

synthetic.pics is a curated generative-art gallery offering browsing, high-resolution digital downloads, and optional custom-gallery services. We reserve the absolute right to modify, suspend, or discontinue any aspect of the Services — including artworks, prices, features, download availability, or accounts — at any time, without notice, for any reason, without liability.

3. User obligations and restrictions

You agree to:

• Use the Services solely for lawful purposes.
• Provide accurate and complete information at checkout and in all communications.
• Safeguard account credentials and download links, and report unauthorized access promptly.
• Not hack, scrape, harvest, reverse engineer, copy at scale, bypass access controls, or transmit malware or automated queries without written permission.

We may, at our sole discretion, suspend or terminate access immediately for any breach — or for any reason we deem appropriate — without refund or liability.

4. Intellectual property and AI restrictions

All content, technology, and materials — including artworks, text, graphics, metadata, and software — are the exclusive property of Pantaleone Digital Services LLC. You may not copy, distribute, publicly display beyond personal sharing with credit, or create derivative works without express prior written consent. Use of any content for training artificial intelligence or machine-learning models, or for building competing datasets or galleries, is strictly prohibited. Unauthorized use may result in termination and legal action.

5. Purchases, licensing, and ownership

Purchasing an artwork buys a license to a high-resolution watermark-free file as described on the Licensing page — personal display and personal prints only, with credit when sharing publicly. Commercial resale, merchandising, advertising use, redistribution, or resale of the file itself requires a separate written agreement. Copyright remains with us; no purchase transfers copyright.

6. Payment and fees

Checkout is processed by Stripe. You agree to pay all fees as listed at the time of purchase, plus any applicable taxes. We may adjust pricing, taxes, or fees at our sole discretion. Non-payment, chargebacks, or payment disputes may lead to immediate suspension of access and delivery, plus pursuit of all available remedies including collection costs.

7. Delivery

• Instant digital delivery: download links are provided electronically upon successful payment confirmation, typically valid for 72 hours, plus a backup email link.
• No physical shipping. Delivery times for custom-gallery services are estimates, not guarantees.
• Re-downloads after link expiry are at our sole discretion and may require proof of purchase. We do not guarantee perpetual availability of any file.

8. No returns, no refunds — all sales final

All sales are final. We do not accept returns, refunds, or exchanges for any products or services, including for mistaken purchases, color or print-output differences, device-display variation, or change of mind. By completing a purchase you acknowledge and agree that the transaction is final and non-refundable to the fullest extent permitted by law.

9. No warranties — as is

Services are provided on an “as is” and “as available” basis without warranties of any kind, express or implied, including fitness for a particular purpose, print fidelity, color accuracy, uninterrupted availability, or error-free operation. You are responsible for verifying that a purchase meets your needs before buying.

10. Limitation of liability

To the fullest extent permitted by law, Pantaleone Digital Services LLC, its members, and officers shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from your use of the Services. Our aggregate liability shall not exceed the total amount you paid to us in the six (6) months prior to the claim, or $50 if you paid nothing. Some jurisdictions do not allow certain limitations; in those cases liability is limited to the minimum extent permitted.

11. Indemnification

You agree to indemnify, defend, and hold harmless Pantaleone Digital Services LLC and its officers from any claims, damages, or expenses (including attorneys’ fees) arising from your use of the Services, your content or conduct, or your violation of these Terms or applicable law. This obligation survives termination.

12. Termination

We reserve the unrestricted right to terminate or restrict your access at any time, with or without cause or notice. Upon termination your rights to use the Services — including unused download links and gallery access — cease immediately, and we may delete associated data without liability. Sections on intellectual property, payments, refunds, warranties, liability, and disputes survive termination.

13. Governing law and arbitration

These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-law principles. Any disputes shall be resolved exclusively through binding individual arbitration in Cheyenne, Wyoming. You waive any right to pursue claims through class actions, collective actions, or jury trials.
